GENERAL TERMS AND CONDITIONS FOR BICYCLE RENTAL

NS BIKE BICYCLE RENTAL SYSTEM

 

BASIC PROVISIONS

Article 1

These General Terms and Conditions regulate the use of the NS BIKE bicycle rental system within the territory of the City of Novi Sad (hereinafter: the “NS BIKE System”), including the rights and obligations of the PUC “Parking Service” Novi Sad and the person renting the bicycle.

SERVICE PROVIDER AND USERS

Article 2

Bicycle rental services are provided by the PUC “Parking Service” Novi Sad (hereinafter: the “Company”).

Article 3

Bicycles may be rented by adults.

Bicycles may also be rented by minors over the age of 16 who possess a valid User Card.

The person renting the bicycle (hereinafter: the “User”) agrees to use the bicycle in accordance with these General Terms and Conditions of the NS BIKE bicycle rental system.

SYSTEM DESCRIPTION

Article 4

The system consists of:

  • Bicycle
  • Rental Station – an area equipped with docking stands, a control terminal, and video surveillance
  • Docking Stand – a bicycle storage and parking unit with individual docking slots
  • Docking Slot – a section equipped with bicycle locking/unlocking functionality and status indicators
  • Control Terminal – a metal enclosure containing the equipment necessary for system operation
  • Video Surveillance System – security cameras used to monitor rental stations

 

ACCESS TO THE NS BIKE SYSTEM

Article 5

A person becomes a User of the NS BIKE System by accepting these General Terms and Conditions and obtaining a User Card.

For users aged 16 to 18, registration must be completed in the presence of a parent or legal guardian, with valid identification documents.

Foreign citizens may become Users after fulfilling the above conditions and paying a deposit of RSD 15,000.

The deposit shall not be refunded if the User fails to return the bicycle or returns it damaged, where the damage exceeds the deposit amount and the User does not agree to cancellation of the User Card.

The deposit shall be refunded if the bicycle is returned in proper condition, without damage or outstanding debts to the Company, and upon cancellation of the User Card.

Each person may possess only one User Card.

The User Card is permanent.

The User Card enables bicycle rental at any rental station.

By using the User Card and taking a bicycle from the docking slot, the User confirms that the bicycle was received in proper working condition.

Users may also access the NS BIKE System through the online platform by scanning the QR code located at rental stations, allowing bicycle rental and online payment by card.

By accessing the system in this manner, the User electronically accepts these General Terms and Conditions without the need to create a physical User Card or sign a contract at the Company’s premises.

Article 6

By signing the Acceptance Statement and receiving the User Card, the User confirms that a contract has been concluded with the Company.

When using the online platform, the contract between the User and the Company is considered concluded at the moment the User electronically accepts these General Terms and Conditions and begins using the service.

By renting a bicycle, the User does not acquire ownership or possession rights over the bicycle.

NS BIKE SYSTEM USER OBLIGATIONS

Article 7

The User agrees:

  1. To use the bicycle responsibly and with due care, in accordance with traffic laws, applicable regulations, accepted practices, these General Terms and Conditions, and the instructions of Company employees.
  2. To protect the rented bicycle and operate it in a manner that prevents damage, malfunction, or destruction.
  3. To allow the Company to charge compensation for damages in accordance with the official Damage Compensation Policy of the NS BIKE System.
  4. To return the bicycle in proper working condition to the location specified by the Company in case of misuse or violation of these Terms.
  5. To notify the Company of the loss or theft of the User Card within 24 hours of the incident.
  6. To accept full responsibility for the bicycle, including its condition and functionality, from the moment of rental until its return.

 

RESTRICTIONS

Article 8

The User is not permitted:

  1. To lend, transfer, sell, or assign the User Card to another person.
  2. To allow third parties to use the bicycle, whether free of charge or for compensation.
  3. To use the bicycle contrary to its intended technical purpose.
    • Riding the bicycle on terrain or in conditions that may cause damage
    • Carrying another person on the bicycle in any manner
    • Any use that places the User or third parties in an unsafe situation

 

USER LIABILITY

Article 9

The User:

  1. Is responsible for all damage occurring during the rental period, from the moment of pickup until the bicycle is returned to the Company.
  2. Must immediately report the loss or theft of the bicycle to the police and notify the Company without delay.
  3. Must report any traffic accident involving the bicycle to the competent police authority and notify the Company immediately afterward.
  4. Remains fully responsible for the bicycle until it is officially returned to the Company.
  5. An adult who enables a minor to access the NS BIKE System, in accordance with Article 5 of these Terms, shall be liable for any damage caused by the minor.

 

DAMAGE COMPENSATION

Article 10

The User shall compensate the Company for any lost, stolen, damaged, destroyed, or missing bicycle or bicycle parts in accordance with the official Damage Compensation Policy of the NS BIKE System.

The Company shall make the Damage Compensation Policy available at User registration locations and on the official NS BIKE website.

 

MONITORING AND BICYCLE PROTECTION

Article 11

The Company reserves the right to monitor rented bicycles. The User agrees that communication related to bicycle rental may be recorded when necessary.

Article 12

In the case of a violation of these General Terms and Conditions, the Company has the right to request immediate return of the bicycle and suspend further use of the bicycle and User Card.

 

COLLECTION AND USE OF PERSONAL DATA

The User authorizes the Company to collect necessary personal data from competent authorities and relevant records for the purpose of fulfilling obligations come from these General Terms and Conditions.

Personal data shall be processed in accordance with applicable personal data protection laws.

Article 14

In case of violation of these General Terms and Conditions, the Company may provide User information to competent authorities in accordance with the law.

SPECIAL CIRCUMSTANCES

Article 15

In the event of malfunction, traffic accident, damage caused by the User or a third party, force majeure, theft, disappearance, or similar circumstances, the User have to:

  • Immediately report the incident to the police and Notify the Company immediately after filing the report for further instructions

 

BICYCLE RENTAL AND RETURN

Article 16

Bicycles may be rented and returned exclusively at official NS BIKE rental stations within the City of Novi Sad.

If a rental station is temporarily out of service, the User must return the bicycle to another operational NS BIKE station.

Article 17

NS BIKE rental stations operate 24/7 during the official NS BIKE season.

If the User fails to return the bicycle at the end of the NS BIKE season, the Company reserves the right to claim compensation fee.

The User must settle all outstanding debts related to bicycle use before the end of the NS BIKE season.

PRICING

Article 18

Rental prices and User Card issuance fees are determined by a decision of the Company’s Supervisory Board.

The Company shall make pricing information publicly available at registration locations and on the official NS BIKE website.

 

PAYMENT TERMS

Article 19

Bicycle rental services may be paid for in the following ways:

  • Using the User Card by depositing cash at the payment terminal located at the rental station, allowing use of services according to the current price list, including hourly and daily passes
  • Electronically, using a payment card through the online platform accessible via QR code located at rental stations

In the case of card payment, the User first tave to accept these General Terms and Conditions.

 

PUBLICATION OF TERMS

Article 20

These General Terms and Conditions are available at all user registration locations and on the official NS BIKE website.

The following documents form an integral part of these Terms:

  1. Decision for NS BIKE rental pricing
  2. Decision of compensation fees for bicycle damage
  3. Special Conditions for Bicycle Rental within the NS BIKE System

These documents shall also be published in the same manner.

 

APPLICABLE LAW AND DISPUTE RESOLUTION

Article 21

For all matters not regulated by these General Terms and Conditions, the provisions of the Law on Obligations of the Republic of Serbia shall apply.

Article 22

Any disputes arising from the use of the NS BIKE System shall be governed by the laws of the Republic of Serbia, and the competent court shall be the court in Novi Sad.

 

FINAL PROVISIONS

Article 23

Upon entry into force of these General Terms and Conditions, the previous General Terms and Conditions for Bicycle Rental and Use within the NS BIKE System dated March 26, 2015, shall cease to apply.

Article 24

These General Terms and Conditions shall enter into force on the eighth day following publication on the official notice boards of the Company.
